Journal Europeen des Droits de l'Homme / European Journal of Human Rights free pdf Presentation du Dossier de ce numero : Les droits de l'homme en reseau par Antoine Bailleux Cet article analyse le developpement d'une justice globale des droits de l'homme a l'aide de la theorie du "droit en reseau" developpee par Ost et van de Kerchove. Il defend l'idee que la metaphore du reseau (utilisee de maniere libre, quoique dans le droit fil de la pensee d'Ost et van de Kerchove) est utile pour decrire et interpreter l'evolution du droit des droits de l'homme ainsi que les strategies utilisees par ses acteurs principaux. Dans cette perspective, la presente contribution souligne trois caracteristiques principales du reseau des droits de l'homme, a savoir sa fluidite, sa polycentricite, et l'interdependance de ses noeuds. Il insiste cependant sur le fait que ces qualites ne constituent pas des proprietes stables du droit des droits de l'homme mais sont bien plutot la resultante de tensions infinies entre ouverture et fermeture, centralisation et marginalisation, solidarite et autorite. En ce sens, la metaphore du reseau nous invite a dedramatiser a la fois les tentatives consistant a (r)etablir une hierarchie et des frontieres et, a l'inverse, les entreprises visant a inaugurer une ere d'oecumenisme des droits de l'homme. Ces tendances antagoniques sont precisement le signe que les droits de l'homme operent dans un environnement en reseau. Pour le dire autrement, ces forces opposees nourrissent plus qu'elles n'alterent le reseau des droits de l'homme. ----------------------------- Abstract of the File of this issue : Human rights in network by Antoine Bailleux This article analyses the development of global human rights adjudication through the lens of Ost and van de Kerchove's "law as a network" theory. It is submitted that the network metaphor (used liberally, albeit in line with Ost and van de Kerchove's thought) is useful to describe and interpret the evolution of human rights law as well as the strategies used by its main actors. In that respect, it emphasises three main features of the human rights web, i.e. its fluidity, polycentricity and interdependence. Importantly, these characteristics are not stable properties of human rights law but they are instead the result of endless tensions between openness and closure, centralization and marginalisation, solidarity and authority. In that sense, the network metaphor keeps us from overdramatizing attempts to establish or restore some hierarchy and borders as well as converse endeavours to usher in an era of human rights oecumenism. These opposing trends are precisely the sign that human rights operate in a network-like environment. To put it differently, these conflicting moves nurture rather than undermine the human rights network.
